Regulatory Committee/ARB Meeting

Materials list and samples for the Goodrich residence to be

The Wright/Peter request for a pool with a 4’ fence to be
located on lot 317 was reviewed.
Approval is pending acquiring
The DeVee request for additional fencing on lot 314, located
at
Construction of the Wiese residence on Lot106H has ceased some time ago and the property is overgrown and an eyesore. The ARB will send the Wieses a letter in accordance with our non-compliance policy, in an effort to determine their intentions so we can decide how to proceed with this situation.
A recommendation was made to begin using all ARB forms and implement all ARB documented procedures, such as inspections, as soon as possible. In addition, it was suggested that we put all ARB forms on the website.
Krallinger Appeal

Old Business:
The issue of dogs on the bridle trail and dogs off leash has not yet been addressed by the developer. In the meantime, a notice will be placed in the newsletter reminding residents of the rules regarding dogs.
The Capp’s residence has been brought into compliance and fixed up a bit by the developer in conjunction with the Capp’s realtor.
Review of documentation outlining Safety and Security issues has been postponed to the next meeting.
There were many questions left unanswered by the developer’s attorney during our meeting of August 8, 2007. A recommendation was made to pursue obtaining independent legal counsel. The developer will be approached with this request when he is back in town.
New Business:
Some areas of the covenants were brought to the floor for discussion:
1. Protection of the bridle trail – is it a common area or owned by individual residents granting use through easements?
2. Laws regarding votes and dues on unsold lots.
It was decided to prepare a comprehensive list of questions that we need to have answered by independent legal counsel.
An assignment was issued to review the covenants for areas that need definition and/or interpretation. A system then needs to be developed to document those changes and track them with the covenants. It was noted that all changes to the covenants are best made prior to being incorporated as an HOA.
